LEXINGTON, Ky. (WKYT) - Two men accused in the murder of a University of Kentucky student faced a judge Friday morning.

Police say Efrain Diaz, Jr. and Justin Smith, along with Roman Gonzalez, robbed and shot Jonathan Krueger on East Maxwell Street in 2015. Krueger was a promising photojournalism student and photo editor at the Kentucky Kernel.
Several motions were filed in the case Friday morning, as attorneys for Diaz and Smith are trying to get the death penalty taken off the table as a possible sentence.
Diaz's attorneys say they plan to argue that his brain development wasn't that of an older adult when he was accused of the crime, so he shouldn't be eligible for the death penalty.
Both suspects will be back in court on July 7.
