New Trial Ordered in High Profile Scott County Murder

The state supreme court has reversed the conviction of a Scott County man, charged in the death of his pregnant ex-girlfriend.

The court ordered a new trial for Roger McBeath in a unanimous decision on Thursday.

McBeath is serving life in prison for the murder of Ashley Lyons. Her body was found in the Scott County Park back in January 2004.

McBeath has been in jail for four years. For all that time, his attorney has been appealing his conviction.

McBeath's attorney, Damon Preston, claims the conviction was properly overturned because prosecutors based their case on testimony from a jail house informant. There are allegations that late enforcement officials used McBeath's cell mate to get information out of him about the murder. Preston claims that violated his client's right to remain silent.

McBeath will have a bond hearing in about a month. If he can meet bond at that time, he could be a free man.

Ashley Lyon's family says they're disappointed with the Supreme Court's ruling, but say they're prepared to do what it takes to make sure McBeath stays behind bars.

A spokesperson for the state Attorney General's office says it will ask for a re-hearing in the case by the State Supreme court. In the meantime, Scott County Commonwealth's Attorney Gordie Shaw says he is preparing for a new trial.
