LOUISVILLE, Ky. (AP) - A judge has struck down a citywide
smoking ban in Louisville, saying one unconstitutional exemption in
the law renders the entire ban illegal.
Jefferson Circuit Judge Steven Ryan ruled Friday that because an
exemption in the smoking ban for Churchill Downs was illegal, the
entire law fails.
In November, Jefferson Circuit Judge Denise Clayton struck down
the exemption that allowed smoking in some parts of the historic
racetrack.
