COVINGTON, Ky. (AP) - A federal magistrate judge says three
lawyers cannot subpoena records of contacts between the FBI and
potential witnesses in the wire fraud case against them.
U.S. Magistrate Judge J. Gregory Wehrman dismissed a series of
subpoenas by attorneys for William Gallion, Shirley Cunningham Jr.,
and Melbourne Mills.
Wehrman did rule that the three men can probe how the FBI and
federal prosecutors put together their case.
Wehrman set a hearing on that issue for Jan. 23.
The three men are charged with defrauding clients out of
millions stemming from a settlement over the diet drug fen-phen.
Gallion and Cunningham were original owners of Preakness and
Breeder's Cup Champion Curlin.
