Louisville Smoking Ban Back In Place

The ban is back in Louisville, as the mayor there signed a new smoking measure into law.

The Louisville Metro Council passed a new smoking ban Thursday night.

The only exception now is for manufacturers that perform research and development on tobacco products.

Last November, a judge overturned the old ban that had exempted Churchill Downs, saying it was unconstitutional.

LOUISVILLE, Ky. (AP) - Louisville's mayor has signed into effect
a reworked smoking ban for all the city's public buildings.

Mayor Jerry Abramson signed the new ban Friday morning. It
removes an exemption for Churchill Downs, a sticking point that
forced a judge the throw out the old ban last month.

A group of business owners had sued to overturn the ban - they
claimed the Churchill Downs exemption provided an unfair advantage
to the race track.

The Courier-Journal reports that the new ban has only one
exemption. It's for manufacturers that perform research and
development on tobacco products.
