Appeals Court Okays DNA Testing For Some Juvenile Offenders

FRANKFORT, Ky. (AP) - The Kentucky Court of Appeals ruled that the state can continue to collect DNA samples from juveniles convicted of sex offenses, but cannot take the samples of juveniles charged with burglary.

The 3-0 ruling issued Friday came in a lawsuit filed by the state Department of Public Advocacy. The public defenders challenged the constitutionality of the state's practice, which began in February 2006, in Franklin Circuit Court.

The DNA is entered into a central database to help solve crimes. DNA also is collected from adult convicts and forwarded to a federal database.
