Judge Won't Delay Trial Of 3 Attorneys Charged With Fraud

COVINGTON, Ky. (AP) - A federal judge in Covington denied defense motions seeking a delay in the trial of three attorneys charged with wife fraud conspiracy in a diet drug settlement.
U.S. District Court Judge William Bertelsman ruled on Thursday, saying the case against Allen Cunningham Jr., William Gallion and Melbourne Mills Jr. will go to trial beginning May 12.
Attorneys for Gallion and Cunningham had asked that the trial be put off, citing complexities of the case and extensive files to review.
Gallion, Cunningham and Mills are accused of keeping millions of dollars that should have gone to plaintiffs in the 2001 settlement of a class-action lawsuit for $200 million dollars over the diet drug fen-phen.
