A two-year old-girl has died after she was rushed to the hospital Tuesday morning. Her mother's boyfriend is now in jail.
Police say the little girl was assaulted inside her Lexington home on Michigan Street.
She was reportedly unresponsive when police arrived at her home. She's now listed in critical condition at Kentucky Children's Hospital.
Police say the toddler was left in the care of her mother's boyfriend, 30-year-old Leamon Wesner. He was initially charged with assault. He's being held in the Fayette County Detention Center.
Wesner's appeared in court at one Wednesday afternoon. The charge against Wesner was upgraded to murder, now that the child has died.
