Jury Selection Under Way In Fen-Phen Retrial

FRANKFORT, Ky. (AP) - Jury selection is under way in the retrial of two disbarred lawyers accused of cheating their clients out of more than $94 million over a settlement with the makers of the diet drug fen-phen.

The criminal case against William Gallion and Shirley Cunningham Jr. moves to U.S. District Court in Frankfort this week after a previous federal jury in Covington was deadlocked on a verdict.

That jury did acquit a third defendant, Melbourne Mills.

Gallion and Cunningham have pleaded not guilty to conspiracy to commit wire fraud and eight counts of aiding and abetting wire fraud.

The two lawyers were already ordered in a civil verdict to reimburse at least $42 million to their former clients. The case also is noteworthy due to the assets of the two defendants, including a minority stake in two-time Horse of the Year Curlin.
