The accused killer, Toby Lasure, appeared in a Fayette County District Courthouse Monday morning.
In court, Lasure's attorneys outlined why he pulled the trigger; killing his lover 31-year old Christopher Tolliver in the middle of the Lexington Green parking lot.
Lasure is charged with Tolliver's murder.
In court, officers who were on the scene testified about Lasure's behavior after the crime. Lasure's lawyers are not denying that their client killed Tolliver, but they say he was acting under emotional stress and say the charges should be reduced.
The judge did not rule on that motion and passed the case onto the grand jury.
