Police say a man was driving drunk when he hit an ATV sending a child to the hospital.

The ATV was on Kentucky 38 near Evarts in Harlan County when a Toyota Corolla crashed into it.

The driver of the Corolla, Jeffrey Wayne Massengale, is charged with his third offense of DUI, possession of an open container in a vehicle and possession of a controlled substance.

The driver of the ATV was airlifted to the hospital.

why is the atv on the road to begin with? where are the parents? why don't the police ban these death machines?

atv.s not made to be on the highways..but i blame the stupid drunk driver..thats all drinking is fit for or drugs..so many getting killed on atv.s,soon they will out law them.cause they r made for the hills,not highways,,but i guess i would do the same if i had one get on road,

Frankly, if the judges would have been tougher on this drunk in the first place, then this accident would have not happened at all! Judges & lawmakers need to get tougher on these drunks! First offense should be $1000.00 fine, 2nd $3000.00, 3rd $5000.00 & the 4th should be 1 yr in prison so they can dry out! But no, the judges baby these people & the rest of us pay for it. You fine them enough, they have no money to buy it. They are no sick, they are making a choice. I know because my mother made the same choice until the state told her to either quit or lose her children. Thankfully, she chose us instead of the alochol! I hope this young one is okay, but the drunk needs jail time to dry out!
