It was just after 1:00 Wednesday afternoon when Tony Barber was lead out of the Flemming County Sheriffs Department. She had been formally charged with second degree manslaughter and criminal abuse in the death of her 18 month old son.

Police say they charged Barber with two felonies, manslaughter and criminal abuse.

Its been nearly 3 months since Kaleb Davis died after his mother found him unconscious in a mini van. The Flemming County Sheriffs Department has been waiting on final autopsy reports before pursuing a case against Barber.

Sheriff Jerry Wagner is confident the evidence is there for conviction.
Wagner says he thinks they have what they need to make a case against her.

Tony Barber will be arraigned Thursday in Flemingsburg.
