A grand jury at the Fayette County Court House indicts a man with manslaughter for the death of 29 year-old Charles Johnson.

Johnson was visiting his sister who lived on Patchen Drive, in Lexington. Johnson was walking out of his sister's home, when police say an accused drunk driver hit and killed him.

Officials say 24-year old Timothy Geneve was driving drunk when he lost control of his pickup truck on August 17th. His truck took out several trees and side swiped parked cars before ending up in the yard where Charles Johnson was standing.

Geneve was originally charged with murder, but a grand jury indicted him for manslaughter Wednesday. The move shocked many people at the Fayette County Courthouse.

The indictment says Geneve committed second degree manslaughter by wantonly operating a motor vehicle and causing Johnson's death. The grand jury also indicted Geneve for operating a motor vehicle under the influence and for not having a driver's license or insurance.

Geneve will appear in court on the manslaughter charges Monday.
