Health of witness concerns prosecutor in murder case

There is a dispute over the testimony of an 80-year-old witness in the upcoming trial of an accused child killer.

Prosecutors want the woman to testify on video, instead of waiting to go before the jury when Cecil New stands trial in February.

Prosecutors say the woman can testify about seeing New near garbage cans where Louisville police believe four-year-old Ivan Aguilar Cano's body was dumped two years ago.

Defense attorneys argue the woman's health isn't bad enough to warrant the taped testimony.

The judge says he'll issue a ruling later.
