A man is in critical condition after being shot in the head. State Police say James Nichols shot Paul Fields at a home in Whitesburg in Letcher county. Fields was flown to a Tennessee hospital. Police charged Nicholas with assault, burglary and wanton endangerment

I suspect that " assult " is just to make sure the shooter is in jail. More serious charges can be filed later. Give the cops a brake foks.

I'm sure I'm just crazy, but wouldn't... sorry I meant SHOULDN'T, a dang head shot be seen as at least attempted murder and not just assault? The assault charge implies it wasn't an accident so what the heck.
