Court: University Not Responsible For Murder/Rape

The Kentucky Supreme Court says a university and a foundation that manages campus dorms cannot be sued over the rape and death of a student attacked in a residence hall.

The high court issued an unanimous decision Thursday in Frankfort.

The high court says Western Kentucky University and the WKU Student Life Foundation are immune from being sued by the family of Katie Autry.

Autry was an 18-year-old student at the university when she was
raped and murdered nearly four years ago.

Autry's family claimed the university and the foundation were negligent for failing to provide adequate security in the dorm.

The decision upholds a ruling by a judge in Bowling Green, who dismissed the lawsuit on the grounds that the university and the foundation were immune from legal claims because they are arms of
state government.
