FRANKFORT, Ky. (AP) - Kentucky's Supreme Court has thrown out a death sentence against Charles Bussell in a 1991 western Kentucky robbery and murder.
It was the second time in seven months that Kentucky's highest court affirmed a circuit courts decision to throw out a death sentence because the defendants lawyer ineffectively represented him at trial.
The court's decision yesterday was unanimous in granting a new trial to Bussell, who was convicted for robbing and killing Sue Lail in Christian County.
If no appeal is filed, it will become final in 20 days and Bussell will be moved off death row at the Kentucky State Penitentiary at Eddyville.
