LOUISVILLE, Ky. (AP) - A former Roman Catholic priest will face a second trial on sexual-abuse charges in October, after the Kentucky Supreme Court tossed out a jury's verdict.

Bullitt County prosecutors said they will retry Daniel C. Clark, 59, starting Oct. 30, in part because he has not taken part in the sex offender treatment program while in prison.

Commonwealth's Attorney Mike Mann said he recently learned that Clark has not been participating in the sexual offender treatment program, which normally takes about two years to complete.

Clark was convicted in 2004 of molesting two boys between 1999 - when one was 8 and the other 9 - and 2002. He was sentenced to 10 years in prison.

The Kentucky Supreme Court overturned his conviction in May, saying the trial judge gave faulty instructions to the jury and improperly allowed a former victim of Clark to testify.

Clark, who has also been accused of illicit acts in 19 lawsuits against the Archdiocese of Louisville, is the only former priest who has had a case heard before the state Supreme Court following the sexual-abuse scandal in the Archdiocese of Louisville. Four priests and two lay teachers within the archdiocese have been convicted of abuse since 2002.

Clark was removed from the priesthood in 2004 after his sex abuse conviction. The archdiocese eventually settled all the cases.
