Lawsuit Against Bush's Domestic Spying Program Dismissed

CINCINNATI (AP) - A federal appeals court in Cincinnati has ordered that a lawsuit against President Bush's domestic spying program be dismissed.

The court says the American Civil Liberties Union had no basis for bringing the lawsuit. It says the plaintiffs couldn't show they were personally spied upon.

A federal judge in Detroit ruled last year that the warrantless wiretapping aimed at uncovering terrorist activity was unconstitutional.

While not getting into the legality of the surveillance program, today's 2-to-1 ruling means the case will be sent back to the Michigan judge for dismissal.

The ACLU led the suit on behalf of lawyers, journalists and scholars it says have been handicapped in doing their jobs by the government monitoring.
