Courtney Bishop appeared in Fayette County Circuit Court Wednesday for a suppression hearing.
The prosecution contends that Courtney Bishop is responsible for beating her son 9-month-old Caleb Bishop so badly that he died from blunt force trauma to his head.
However, during today's hearing the defense made it clear, it plans to try and convince jurors that it was not Courtney Bishop who killed 9-month old Caleb but rather the child's father.
The prosecution anticipated the defense would blame Daniel Bishop, for beating the child to death. So, prosecutors asked the judge to have details about his history of domestic violence and drunk driving, be excluded from the trial. Courtney Bishop's attorney claims Daniel Bishop's criminal record must be included in the trial, because Courtney Bishop originally defended her husband, saying he could never hurt Caleb.
Now her attorney claims Bishop knows more about her husband's criminal past, and believes he is responsible for killing their son. That means she'll have to take back her defense of her husband on the stand. Judge Thomas Clark says for that reason; Daniel Bishop's criminal history will discussed at trial.
Bishop's trial is set for March 15.
