Jail officials say it was a mistake. A man who was supposed to be behind bars was set free Monday night.

They say Richard Allen Simpson was released instead of another inmate, with the same last name, who was supposed to get out.

Instead, they let the wrong Simpson go. He was behind bars for violating an emergency protective order.

Simpson spent the night a free man and then turned himself in around noon on Tuesday.

Police say he won't face additional charges because it was their mistake he was set free.
