Judge Rules Blue Grass Airport Can't Be Sued Over Flight 5191 Crash

LEXINGTON, Ky. (AP) - A judge has ruled that Blue Grass Airport can NOT be sued over last summer's deadly Comair plane crash.

The ruling virtually exonerates the airport from any financial liability.

Comair had sued the airport and the Federal Aviation Administration, claiming they should share in the blame.

But today a Fayette County circuit judge ruled the airport enjoyed sovereign immunity because it is part of the Lexington-Fayette County government.

Comair argued that the legislative protection should not apply because the airport operates financially independently of the government.

Lawyers for the airline had no immediate comment after the two-hour hearing.
