Surrogate father awarded custody of boy saved from fire

There are new developments involving a 5-year-old boy who caught national attention when his nanny saved him from a fire.

A judge ruled the child's surrogate father will have sole custody of the child.

The Shelby county man, J.B. Hawes, is not the biological father and was out of town when the fire broke out in his home.

The child's 22-year-old nanny, Alyson Myatt, ran barefoot through flames to save him.

The child's mother, who lives in Lexington, plans to appeal the ruling.

The Lexington Herald-Leader reports her attorney argues the mother's criminal record was unfairly held against her in the custody dispute.
