LEXINGTON, Ky. (AP) - A 54-year-old Lexington man had been charged with murder, but defense attorney Gatewood Galbraith convinced a jury that his client was too drunk to form an intent for the crime.
A Fayette Circuit Court jury convicted Michael Kollros of second-degree manslaughter yesterday for the fatal shooting of 45-year-old Daniel Butcher. Witnesses testified that Butcher was staying at the Kollros residence after the two men had spent a day of heavy drinking.
Kollros said he shot Butcher in self-defense. Galbraith said Kollros was too drunk to form an intent for murder.
The jury also had the option of convicting Kollros of reckless homicide or first- or second-degree manslaughter. Galbraith asked jurors to convict Kollros of a lesser charge than murder if they did not think he acted in self-defense. The jury recommended Kollros serve the maximum sentence of ten years in prison. A formal sentencing is scheduled for September 21st.
