CHARLESTON, W.Va. (AP) - Powerball winner Jack Whittaker has settled a lawsuit with City National Bank of West Virginia over the cashing of $49,000 in forged checks.

Kanawha County Circuit Judge Duke Bloom dismissed the lawsuit after the parties reached an agreement, his office said Thursday. A trial had been set for next Monday.

Whittaker's company, Whittaker LLC, sued City National in January, claiming the bank was negligent because tellers cashed $49,000 worth of checks drawn on the company's account in September 2006.

City National countered by claiming the checks bore what appeared to be a mechanically reproduced version of Whittaker's signature. The bank also said each check contained Whittaker's account and check numbers.

City National attorney Ancil Ramey told Bloom an internal investigation found none of its employees had done anything wrong.

A criminal case against a Kentucky man who's accused of taking money from Whittaker's account under false pretenses is pending.

Whittaker won a $314.9 million Powerball jackpot in December 2002 and he took a $170 million lump sum payout - or about $93 million after taxes.
