Arson investigation upgraded to a murder investigation

Updated: Mon 7:55 PM, Oct 22, 2012

Clark County, Ky. (WKYT) - Neighbors call the burned home on East Broadway Street a party house. They say that the people that lived there often played loud music and were often under the influence. They also say that police are often called out to the home, but never thought any of that would amount to a murder investigation.

The fire happened early Sunday morning.

"There we flames like shooting up on the side of the house. It was crazy. I didn't know to think or what to do. All I could think was get everybody away from here," says Holley Means, a neighbor.

Investigators determined Sunday that it was arson.

"I figured it was probably like a stove for. But they were over there drinking so anything could have happened, " adds Means.

Police say fifty-year-old, Kenny Payton was murdered. The autopsy confirmed that Payton didn't die of natural causes or from the fire inside the East Broadway home.

Neighbors like Means are in disbelief that the man they'd see in the yard next door is no longer alive.

"He was out mowing his yard and stuff, playing with his dogs every now and then. but he never talked with anybody really or bothered anybody," says Means.

Police say twenty-three-year-old, Aaron Spencer started the fire. He is charged with arson. According to the arrest citation, witnesses tell police that Spencer poured gasoline inside the home.

Brandon Adams grew up with Spencer and is shocked that his friend is in jail for a crime like this, "I've known Aaron my whole life. This ain't Aaron he's a big cuddly bear. He ain't no violent person."

We checked court documents and Spencer has had several run-ins with the law. Some of the crimes he has been convicted of are possession of a controlled substance, fleeing and evading, as well as public intoxication.

Kentucky State Police continue to investigate and say that more charges could be filed. So far no warrants have been issued.
