Hearing delayed for man accused of abusing cat

RICHMOND, Ky. (WKYT) - People interested in the case of a kitten, badly injured with a golf club, will have to wait to see what happens next.

Police say Gary Foster, Jr. badly abused the cat, who is known as Lucky.

A preliminary hearing scheduled for Wednesday morning was postponed two weeks.

Foster's attorney tells us they asked for the preliminary hearing to be pushed back because the arresting officer did not show up.

The Commonwealth's Attorney says the officer's subpoena came back undelivered and both parties agreed it was important the officer be there.

Lucky's supporters were not happy to hear the news.

"This is so horrific to me that for the first time I said no," said Deanna Walters. "It's too close to my backyard. I can do something and it may not be enough but I'm doing what I can."

Lucky is said to be doing well.

Foster faces a felony charge.
