Lexington police were on the scene of an accident involving a pedestrian along East New Circle Road late Tuesday night.

Police tell us it happened just before 9 p.m. on the outer loop of New Circle Road. The male pedestrian was hit by a SUV near Golden Corral.

We are told that pedestrian was walking in the middle of the road where there isn't a crosswalk. He was taken to UK Hospital with life-threatening injuries. The coroner's office says he later died of those injuries. The 55 year Fayette County man's name will be released upon notification of his family.

The Commonwealth's Attorney Ray Larson was on scene earlier as well, checking out what was going on and if any charges would be filed. Right now police can't say if the driver will be charged, stating it's too early in the investigation.

"At this point it appears the person was attempting to cross New Circle Road. We're not 100 percent certain on the direction from which side to the other. We just know that they were in the middle of the outer loop," said Lt. Chris Young with the Lexington Police Department.

We don't have an update on the victim's condition at this point who is still at UK Hospital.

Police are asking all drivers to avoid that area of East New Circle Road.
