Lexington daycare owner arrested on abuse charges

LEXINGTON, Ky. (WKYT) - A Lexington daycare owner is charged with abusing a child in her car.

According to an arrest warrant, Sevola Marks was caught on cell phone video abusing a child under the age of 12 at the Children's Treehouse of Knowledge on Ohio Street.

Marks is charged with third-degree criminal abuse for the alleged abuse that happened on May 14th.

Police say the video shows some of the abuse, which according to the report includes bending a child's fingers back to cause pain, giving him a friction burn on his arm, and bending his arms back in such a way to restrict breathing.

"Those things are all untrue, I believe fabricated by the employee with the cooperation of the mother of the child," said defense attorney Matt Boyd.

Boyd tells us he doesn't believe the child was abused because he claims that child was back at the daycare Thursday.

According to Boyd, the Children's Advocacy Center of the Bluegrass started investigating several weeks ago and they were preparing to drop the case. He says they were shocked when police arrested Marks Wednesday.

"We were blind-sided, myself and her other attorney. We expected that our cooperation and willingness to let them find the truth would result in an unsubstantiation of the cabinet's charge and also no criminal charges," he said.

Tisamiracle Carter's two daughters are enrolled at the daycare. She says she is standing by the woman she trusts her children with.

"Her beat-downs are not a beat-down, they are a hug. Even when they are in trouble there is no kind of abuse, it's a hug," she said.

Marks plead not guilty during her arraignment Thursday afternoon.

Her case is scheduled for a status hearing on July 17.
