A man accused of killing two people in a crash back in 2010 is headed back to jail.

A Scott County judge ordered Jeffrey Bailey serve jail time for violating the terms of his bond. Bailey was supposed to report each night about his whereabouts for the day to a monitoring company. The judge determined he failed to do so properly.

Bailey is charged with the murders of 29-year-old Anna Hamilton and 32-year-old Brian Way. Police say Bailey was driving drunk on U.S. 25 in June of 2010, when he crashed, killing Hamilton and Way.

Bailey spoke in court today, telling the judge he and his attorney believe the monitoring equipment could be malfunctioning and not accurately showing his location. The judge disagreed.

"I have many, many people on monitor release using the same company. You're the only person that has reported problems with it," says Judge Paul Isaacs.

It all centered around a few days Bailey spent time at a restaurant and bar, Doogans in Georgetown. Officials say Bailey didn't report those visits, and instead said he was at Lowes.

In court today, Bailey says he was at the restaurant, but it was all work-related.

"He doesn't drink alcohol at all. And the proof was that he's not drinking. He's up there, he meets his partner there and his partner is feeding his children," says Bailey's attorney, John Cornett.

Bailey's trial is scheduled to begin on October 29th. The judge warned Bailey that if he had another mishap, he would be in jail until the start of the trial.
