HEIDRICK, Ky. (WYMT/WKYT) - BARBOURVILLE, Ky. (WKYT) - It just after midnight and police say a man was walking down railroad tracks in the Heidrick community when he chose to break into a van on Morris Lane.

"We do know he was inside the van...he took a small change purse," said Kentucky State Police Trooper Shane Jacobs.

A neighbor across the street witnessed the theft and called police. But before they arrived...he and the van's owner confronted the thief at gunpoint.

"He (the thief) started to leave..they attempted to stop him and an altercation took place," said Jacobs.

The thief ran off. The neighbor fired his gun and the man later died at Knox County Hospital.

"The homeowner nor the neighbor knew the subject. Neither one knew him," said Jacobs.

Police say the man killed is Randy Shane Maybery, 30. He's from Texas but he recently served time in prison in Kentucky on burglary and firearm charges. Police say they believe he chose the van totally at random.

"I would advise you to keep your doors locked keep your residence well lit to avoid any of this," Jacobs said.

No charges were filed against the shooter but a grand jury will likely consider the case.
