Powell man sentenced for deadly crash

Updated: Wed 7:08 PM, Feb 20, 2013

POWELL COUNTY, Ky. (WKYT) - After a two week delay, a Powell County family now knows how long the man who killed their relative will spend in prison.

A judge sentenced Brian Epperson on Wednesday to six years behind bars. We're told he will get credit for time served.

A jury found Epperson guilty of second-degree manslaughter, fourth-degree assault, and DUI after a 2011 crash that killed Donald Tharpe.

Police say Epperson was under the influence of Xanax, Methadone, and Oxycodone at the time of the crash.

Tharpe's daughter says Epperson could be eligible for parole in a little more than a year and that's been hard for their family to accept.

"He's still living, breathing, walking, and talking, our dad ain't. He's gone and never can come back," said Peggy Plowman.

A judge delayed sentencing two weeks ago, because his attorney hadn't filled out the necessary paperwork.
