Transportation group to appeal bridges ruling

LOUISVILLE, Ky. (AP) - A public transit and cycling advocacy group is asking the U.S. 6th Circuit Court of Appeals to review a decision rejecting a lawsuit challenging the $2.6 billion Ohio River Bridges Project.

The Courier-Journal reported that the Coalition for the Advancement of Regional Transportation says U.S. District Judge John G. Heyburn II erred when he dismissed the group's lawsuit in July.

Heyburn ruled that the states and the Federal Highway Administration "reasonably exercised their discretion in making decisions about the project's scope, design and financing."

CART claims the Kentucky and Indiana broke federal civil rights laws by discriminating against minorities when adopting a tolling plan that would disproportionately affect those residents. Heyburn rejected that claim as well as allegations that the states violated federal funding regulations and environmental laws.
