Victim's family frustrated after sentencing delayed in Powell Co.

POWELL COUNTY, Ky, (WKYT) - A Powell County judge delayed the sentencing Wednesday morning of a man found guilty of manslaughter in a deadly crash.

In court on Wednesday, the judge talked to Brian Epperson and his attorney before the hearing and announced he still needed to obtain some pre-sentencing paperwork before a punishment could be handed out.

Investigators said Epperson tested positive for several controlled substances, including xanax, methadone and oxycodone, after he collided head-on with a truck killing the driver, 65-year-old DonaldTharpe.

Nearly a dozen family members of the victim were in court to hear the sentencing. They told us they are frustrated at the delay.

Epperson's hearing has been continued to February 20th, the family told us they will be back in the courtroom.

The family tells us they anticipate Epperson will probably only have to serve a year in prison, before he is eligible for parole.
