FRANKFORT, Ky. (WKYT)- Gunshots rang out along Manley Leestown Road in Frankfort in September. Police quickly find an elderly woman, Patricia Tate, had been hit in the head with a bullet. The shooting suspect, 38-year-old Mona Lisa Maupin, was hiding in a field. Now, Maupin gets to go home for Christmas.

"Very apprehensive because this was a serious crime," explained Franklin County Commonwealth's Attorney Larry Cleveland.

Cleveland says Maupin has been charged with intent to commit murder. Tate's family members say she'd been visiting her grandchildren and was sitting on a couch in this home when she was struck.

"A bullet lodged in her forehead. The bullet cannot be removed because of the perceived risk of damaging the lady's eyesight," Cleveland said.

On Friday, circuit Judge Thomas Wingate decided Maupin Could go home from 8 Christmas Eve until 8 Christmas night.

"The argument was that she needs to spend time with her children at Christmas. That being away from their mother would be damaging at Christmas. You also have to think how does this elderly woman like having a bullet in her forehead at Christmas?"

Tate's family did not want to appear on camera, but they say they are outraged Maupin was released, even if it's for a short time. They say while she's celebrating Christmas with her family, they'll be celebrating in fear.

"We just have to keep our fingers crossed and hold our breath that nothing happens," Cleveland commented.

Maupin will be outfitted with an ankle monitor for her 24-hour furlough... But Cleveland says she shouldn't get out of jail free at all.

"We'll keep as close an eye on her as we can."

Maupin is in jail on a $100,000 bond.
