Governor Beshear is asking the Franklin Circuit Court to throw out the lawsuit Senate President David Williams filed against him.

Williams filed the suit last month claiming Governor Beshear illegally curtailed legislative power by scrapping the legislature's highway construction plan and replacing it with one of his own.

In a motion filed Monday, the governor said the legislature's plan wasn't legal because it was passed after April 15th.

April 15th is the deadline for the general assembly to adjourn.
