Boyle County Murder Trial Delayed

New information in the murder trial of an 82-year-old Danville man.

27 NEWSFIRST has learned the case against Jack Caldwell won't resume for weeks.

Caldwell's attorney says his client is still being treated for a staph infection in the hospital.

It's expected to take at least three weeks for him to heal.

The judge says the trial will stay on hold until mid-January.

Caldwell is accused of killing his neighbor, Jim Trachsel, in 2004.

Caldwell's defense attorney tells 27 NEWSFIRST they have 13 more witnesses to call, including Caldwell himself, who he says will have to testify since he is using a self-defense strategy.

We are also told the jury will go to the scene at some point during the trial.

DANVILLE, Ky. (AP) - The trial of an 83-year-old man charged with murdering his neighbor in central Kentucky has been continued until at least January.

Boyle Circuit Judge Darren Peckler ruled today to delay the trial mainly because defendant Jack Caldwell Senior is battling a contagious MRSA staph infection.

Peckler says the courtroom is not designed to be a hospital ward and it would be difficult to accommodate Caldwell's needs.

Treatment for the staph infection will take another three weeks to run its course.

The judge told jurors he would call them around January 15th to update them on the status of the trial.

    Bravo to Bill in Lexington. He's 100% right. Why is he fighting what obviously was done? To say you're innocent and protecting yourself is one thing ... to have a gun with you while you're mowing the yard is something else ... a little bit of premeditation going on here ... hard to prove, but obvious to the most casual observer. I worry about his soul. It's time he sets it right and move on to the next life. It's a pathetic story.

    I think this is sad the way they are using this man for TV viewing he looks so pitiful in the hospital bed with lawyers talking to him and he isn't responding. Our community is at wrong for doing that. If what he did is wrong he will answer for it when God sees him. Let him rest and his family he looks so sad on TV. He doesn't know anything right now.

    well either way this guys punishment is coming to him, if not in this life then in the next. he needs to stand up be a man plead guilty and die in peace. at his age and health he should seek forgivness, not excuses

    If this man did kill the other man, that is wrong....but this poor guy is suffering himself...QUIT wasting our tax money by making a mockery out of this!!

    Even if this man makes it through the trial, he probably won't survive very long in prison if convicted! If convicted, he becomes a ward of the state and our tax dollars will pay for his medical care and funeral expenses! A killer gets revenge on his enemy and the government at the same time! Pretty good, huh! The victim looses his life and the killer gets taken care of with taxpayers dollars! Great system we have going here, isn't it!

    This is usually how it goes. The attention is always set on the suspect and the victim is long forgotten.

    he should be on trail they are to go ahead and but him out of his miserybecause what he done by shooting someone over their yard is just unbelieveable. my heart goes out to the Trachsel family and his poor wife.

    This occured in 2004, its almost 2008. Why worry about it now, 4 years later? I just don't understand some things.
