Sex Offender Pleads Not Guilty To The Murder Of 4-Year-Old Boy

LOUISVILLE, Ky. (AP) - A convicted sex offender pleaded not guilty Thursday to kidnapping and killing a 4-year-old neighbor who was found in a garbage truck.

A judge set a $1 million bail for Cecil Eugene New II during his arraignment in Jefferson Circuit Court.

New was charged Wednesday with killing Cesar "Ivan" Aguilar-Cano, who disappeared near Churchill Downs on June 29. He was found in the back of a garbage truck eight days later.

New is charged with murder, kidnapping, tampering with physical evidence and being a persistent felony offender. Prosecutors plan to seek the death penalty if he is convicted.

New has been on the Kentucky sex offender registry since March 2000. He was convicted of sodomy involving 11- and 9-year-old victims in northern Kentucky.

New's attorney, public defender Jay Lambert, filed a motion asking that all evidence in the case be preserved. A court date has been set for Jan. 23.

Ivan was buried in his mother's hometown of San Juan Tapalapa, Guatemala, in August. His mother, Rosa Cano, who is in the United States illegally, was granted a special visa allowing her to leave and return to the country as a material witness in the criminal investigation.

    Some of you talk about voting for politicans that will change the laws. Are you for real? NO ONE LAWMAKER CAN MAKE A LAW OR CHANGE THE LAW! Those laws have to be voted on by the whole General Assembly or Congress! I agree vote your hearts, but do not expect one lawmaker to make a difference all on his/her own! They all have to play a political cat and mouse game to get votes on laws they want and sometimes that means voting on things they really don't like. Sadly most of our leaders are out of tough with the citizens they represent. McConnell and Chandler come to mind. Voting is our right, but none of our lawmakers can get tough on crime by themselves! I would love to see a change in the law to get tougher on criminals, but I cannot see that happening because of such groups like the ACLU! Every time a judge is tough, the ACLU comes along and crys about the criminals right's. If you want to do something that WILL bring change, get rid of the ACLU and groups like it!

    Even though I think that this guy needs the death penalty...Cindy has a good point. Also the fact that was said several times in this thread as well is that we have way too many LIBERAL law makers and judges as well as prosecutors but those that vote them in are the ones that are too blame. Quit voting your mind and vote your hearts, values, morals, etc and maybe we will finally get folks in that will do what we need done... especially with a guy like this.

    What happened to this poor child is a travesty, but when are we going to start holding parents responsible for their neglect? This 4yr old child was playing outside his apartment building UNSUPERVISED. Would you let your 4yr old run around by himself?

    Hey...don't put the blame on LIBERAL politics...conservatives are just as bad. (the LAST governor was a conservative) Nearly ALL politicians are bad!!! They have to make promises to the "majority" that will give them enough votes to become elected. Look around...it is the voters who put these clowns in office. Anytime a judge or jury is stern with sentence, someone like the ACLU gets involved and says the punishment is against their constitutional rights. As far as I am concerned, when you commit a crime such as this, you no longer HAVE rights!!!

    i say turn him over to the family of the child they will take care of him.he should have never ben let out of prison they allways do the same thing.we donot have justis in this country no more.if it was some one protecting ther home they would gotten life the justis system dosent work anymore.let him rot in prison.

    Keep electing liberal lawmakers, keep getting stuck with liberal laws and sentences. Is the answer starting to come to any of you yet? Most of these comments can be paraphrased as "Throw the book at him!". But our liberal legislature and liberal judges have turned that book into a softcover, so throwing it at him a dozen times wouldn't phase him in the least.
