Students Claim They're Still Waiting For Refunds From Alleged Scam Save Email Print

Several college students, in both Kentucky and Ohio, say they're still waiting for refunds from a Lexington man they claim took their money.

"Every time we called him, if he picked up the phone, he would have some type of excuse every time," Ohio University student Haley Scullin said.

She's talking about Tommy Case. Scullin says for a year now, she and her friends have waited for money they say he stole from them.

They say they each gave Case hundreds of dollars, thinking it would pay for a spring break vacation to the Bahamas. But Scullin says she soon found out something was wrong.

"The trip was coming up within a week, and we had no itinerary, tickets, and no plane information. Nothing," Scullin said.

Scullin says she and her friends never made the trip. And now, they just want their money back.

"I think he spent it," Scullin said, referring to Case.

27 NEWSFIRST attempted to contact Case, stopping by his Lexington home. He wouldn't talk to us, but his mother, Vicki Witt, did.

"It was a nightmare for all of us," Witt said.

She says her son fell victim to an online scam.

Witt says her son used the money to book the trips online through a company called Coastal Vacations, thinking it was legitimate. But Witt says the company was just a fraud.

"He swore to me, 'Mom, I don't have the money, I didn't just cash the money and spend it, I wired it to them (Coastal Vacations),'" Witt said.

But Scullin says that doesn't matter. She says it's still Case's responsibility to pay the money back.

"We are taking this by storm, we want to do everything we can to get our money back," Scullin said.

"As he has the money, as he can do it, he's still going to pay it back," Witt said.

Tommy Case has not been charged with a crime. Right now, police say the case is a civil matter, not a criminal one.

What? Not a criminal matter? When is theft not a criminal offense? He took their money & did not delivery the product: that's theft! I can only guess it was over $300 & he should be charged with theft by deception! The man should have checked out the company with the BBB BEFORE he took the student's money! He is responsible! The student's should contact the Attorney General's office & file a complaint with them. It's a shame that someone can steal money & it NOT BE A CRIME! I find this hard to believe! The students should also file a lean against the man until they get their money back. Garnish his wages & anything else he has until you get your back back. And NEVER get your money to anyone other than a legal travel agent when planning a trip!

He needs to pay the students back...Take out a loan or something...It's not their fault he messed up.
