Lexington Man Killed In Early Morning Crash

LEXINGTON, KY -- A 48-year old Lexington man was killed in a two-car collision shortly after 4:30 a.m. Sunday where alcohol use is suspected, according to the Lexington Police Department.

The victim has been identified as Dennis Michael Poset. The driver of the other vehicle, 24-year old Charles M. Andrade, was unharmed.

Police say the crash occured at 4:37 a.m. involving a Jeep Cherokee driven by Poset inbound on Tates Creek Road and a Ford Explorer driven by Andrade traveling east on Man O' War Boulevard.

Authorities say Poset apparently ran a red light and Andrade was unable to avoid a collision at the intersection. Police say both drivers apparently had been drinking and Poset was not wearing a seatbelt.

Poset was transported to U. K. Medical Center where he was pronounced dead by the Fayette County Coroner's Office.

Funeral arrangements for Poset are being handled by Kerr Brothers Funeral Home of Lexington.

Failed to mention other driver Charles Andrade was taken into custody and charged with DUI. Even though it was not his fault, can he be charged with vehicular homicide since alcohol was involved and his judgment was also impaired??????? what do you think?
