Gov. Beshear Asks Court To Throw Out Highway Lawsuit

FRANKFORT, Ky. (AP) - Gov. Steve Beshear has asked a court in Frankfort to dismiss Senate President David Williams' lawsuit over the state road construction plan.

The motion was filed Monday in Franklin Circuit Court.

Republican Williams claims in his suit that Beshear - a Democrat - illegally curtailed legislative power by scrapping the legislature's highway construction plan and substituting one of his own.

In a reply to Williams' lawsuit, Beshear said the General Assembly's road plan isn't legal because it wasn't passed in time.

It was contained in House Bill 79, which Beshear said was signed by leaders of the House and Senate after midnight on April 15.

State law requires the Legislature to adjourn by then.
