A Breathitt County man recovers from a weekend shooting and the man police say pulled the trigger says he shouldn't be the one behind bars.
Marc Gross is charged with assault.
Marc Gross admits Saturday wasn't his first violent encounter with Gary Herald.
This time shots were fired.
WYMT’s Michel Mason talked to Gross at the Three Forks Regional Jail where he said he and Herald have been at odds for awhile.
The two men live along highway 315 in Breathitt County's Sebastian Branch.
Gross claims he pulled over Saturday afternoon because his car was overheating, when Herald came up and began attacking him and eventually pulled a gun and opened fire.
Gross says he had no other choice but to shoot back.
He didn't think police would charge him.
“I thought they was going to let me leave. Because I hadn't done nothing wrong. I mean he was shooting at me. I think in this world you got self defense to protect yourself,” Gross said.
The Breathitt County attorney says the two men have filed complaints against each other in the past, but didn't want to file charges.
Jimmy Herald, who says he's a nephew of Gary Herald, told us a much different story.
He claims his uncle didn't even have a gun and was shot in the back.
Gary Herald had surgery at UK Medical Center.
Gross is being held on a $25,000 cash bond.
