Elected Officials Accused of Assaulting Man

Living next door to the county Constable, you would think a man would feel safe. Instead a Lancaster man says his next door neighbor used his position to intimidate him.

Nicholas McCoy says for the last 3 1/2 months he's dealt with lights and sirens when he goes to bed.

"That just got old. The lights and everything flashing through my house", says Nicholas McCoy. So, this past Sunday night he had a solution. He called police on his neighbor, Mike Mullins, a Constable in Garrard County, but says he didn't get the help he expected. "I guess they called him and let him know and he came to my house beating on my door", McCoy says.

McCoy says he asked Mullins to leave his property, but he wouldn't.
"He continued to verbally assault me and another Constable pulled up and it just got worse from there", McCoy says.

That Constable was Brad Smith who McCoy says had been drinking.
"I'm 99% sure he had alcohol on his breath!", says McCoy. Nicholas McCoy says both men then handcuffed him. "They assaulted me some more and continued to ask me why I made the complaint", says McCoy.

The incident was all caught on the phone. McCoy had called police back when Mike Mullins first arrived at his door so that they could hear everything.

The incident has now landed the two Constables in some trouble they haven't been in before. "What we did do was suspend their right to use blue lights, asked them to return their badges, and suspended their rights to use radio frequency from our dispatch center", says John Wilson, the Garrard County Judge-Executive.

What they couldn't do was remove them from office since they are elected officials. This is something Nicholas McCoy says he just doesn't agree with. "I feel like it's wrong. I really do. Either voted in or not voted in, I think both should lose their job. They assaulted me and they had no right to do what they did to me", McCoy says.

Nicholas McCoy tells us he is planning on getting an attorney and plans to file a lawsuit. He also tells 27 NewsFirst he was told today if he signed a waiver not to sue the county, the two Constables would resign. The Judge-Executive says that offer was never made.

What about that. Also i hear Mr. McCoys past is un godly full of crimes. and he has a court date this month in Boyle County. nicole were does it say he was offered "MONEY"? seems you need to get your facts straight before popping off!

    FIRST OF ALL WHATS MR MCCOYS PAST HAVE TO DO WITH THIS? OR DOES IT? DID MULLINS KNOW THIS AND IS THE REAL REASON FOR THE HARRASSMENT? I SEE THE TRUTH IS COMING OUT! NICOLE IF THESE MEN ARE GOOD AS YOU SAY SHUT UP YOUR JUST KEEP DIGGING THE HOLE DEEPER FOR THEM! HAHAHAHAHA GLAD YOUR NOT ON MY SIDE!

    Nicole how would you like to randomly be attacked, handcuffed, and thrown onto the hood of a cop car!??!?!?!?? And rumours can be decieving, don't listen to everything you hear. And McCoy didn't start the trouble...

    Boy you sure got the joke part right Nicole its a Joke to think you would be here trying to defend two ppl that have already been punished by the Courts that have taken their radios and badges & Lights saying thats all they can do to them seeing as they were voted in ? & you stand here still saying their two good guys ? haha yeah your right Nicole Thats truely a Joke!

    If the constable was gonin t oconfront McCoy about the issue it should have been done in their own time, not in uniform, this siuation could have been prevented by talking peace with mccoy instead of using their piggish ways against them.. and dont give me a constable speech because my father is a constable where I live, and treats people like human beings, instead of below the law pee-ons, thank u for your time!

    No offense but to those posting comments, no matter what your personal feelings are towards Mr. McCoy - that has nothing to do with what happened. This is clearly an abuse of power situation and it does demand some force of action to be taken place. It happens a lot. I will leave my personal feelings towards the Garrard County law enforcement out of this because I know a lot of stories very similar to this that happened to some of my close friends. If there is a lawsuit filed, that is up to Mr. McCoy and I wish him the best of luck if he goes through with it. If not, it needs to be a wake up call for all of those who do think they can get away with anything just because they carry a badge.

    EVERYONE THAT HAS POSTED A COMMENT ABOUT THE YOUNG MAN LIEING, ALL I HAVE TO SAY IS DIDNT YOU NOT HEAR THE NEWS REPORT THAT STATED THAT THERE WAS A 911 DISPATCH TAPE THAT RECORDED THIS? AND IF IT WAS A LIE, WHY DID THEY TAKE THEIR RADIOS AND BADGES? THAT SHOWS THEY WERE DOING SOMETHING WRONG! AND THAT IS A FACT! AND FOR NICOLES COMMENT IF THE DEPUTY SHEIRFF HAD DONE HIS JOB, MULLINS AND SMITH WOULD HAVE BEEN LOCKED UP FOR PUBLIC INTOXACATION AND DUI! SINCE SMITH HAD TO DRIVE TO MULLINS HOME!

    Constables should be paid much more{at least as much as a comander on the state police force} then the aveage cop.So that we can attract more better people to the office.Some one needs police the police in Kentucky its badly needed.
