New Trial For Man Convicted Of Child's Death

A Letcher County man convicted in the death of a two and a half year old foster child will get a new trial.

In 2006, a jury found Jeff Allen guilty in the 2003 death of Dakota Yonts and he was sentenced to 50 years in prison.

Officials say Yonts died of blunt force trauma with strangulation as a contributing factor.

Commonwealth's Attorney Eddison Banks could not comment since this is a pending case, but says his office is planning to re-try the case.

    You need to keep your mouth shut if you don't know the truth. Some of you should read the facts before talking about people. Jeff would never do this. For those people know him know that. Those who are just listening to the news and papers you don't know. Don't be so quick to judge.

    D.U.I they would be a public hangin here but a thing like this would be a slap on the rist they let these people off to easy teachers, murders, plus the child molesters

    I am so glad for Jeff that he has been granted a new trial. When this first happened, had I not known them I would have said "how awful, how could these ppl have done this?" But I do know Genia and Jeff and love them dearly. They BOTH are INNOCENT. Since this has happened I don't judge news stories that I "hear" as I once did, because I know that I don't know the whole truth. The only thing Jeff's trial proved is that taxpayers money was wasted, the judicial system is a crock and there is no such thing as "innocent until proven guilty in a court of law". Preconceived notions tainted everyone who did not personally know Jeff and Genia. There was nothing fair about this trial and certainly nothing fair in the loss of a child. But sending someone to prison for life for something they are not guilty of is wrong!!

    If you had hit someone while driving under the influence and would have killed someone then you would have been a murderer too. You should have been put under the jail! Low life, you're no different than a molester or murderer.

    when I got a D.U.I I had a trial an found guilty I wonder If I can have a retrial I no it wont work they just give that to murders an molester plus teachers its provin in this county. this is a good place for him they prob let him free with a slap on the back like they do them teachers an other molestin killin machines

    ok, the first thing i want to say is i cant believe they are giving this so called man another trail, he blamed a little kid for what happened, ok tell me how a adult mans hand print was around its little neck,and to be hit in the stomach that hard another kid about 6 years old at the time could not have done it ,we all live here in letcher county we know what happened, and his wife getting nothing ,well that was wrong, maybe they will get her this time,This is crazy to let this man have a trail if he is convicted again are we going to keep on going with it until they set him free, this stupid,

    I just want to say that Jeff was wrongfully convicted of a crime that he didn't do,However TAXPAYERS MONEY has been wasted on INNOCENT MANS prison confinement not to mention the prior jail time.I am so thankfull that Supreme Court is ordering a new trial,I believe round 2 will be whole differnt ballgame..DONT YOU!

    There was error in the trial, you all are from Letcher County and around there watch the news and read the news papers smart ones.
