Video will be available shortly

Jessamine county authorities say they have surveillance video of Melissa Helton buying alcohol. The Jessamine County mom is accused of driving drunk when she crashed her van into a tree earlier this month killing three children -- including one of her own.

News of the video tape from a Rite Aid surveillance camera came during a motion from Helton's attorney, Ed Dove, to have access to it.
It could prove to be key evidence in the defense case, bringint into question who bought liquor the day of the crash.

The prosecutor said he's not sure if the sheriff's office has the tape. If so, a copy would be made.

The judge also approved the defense motion to preserve blood evidence taken from Helton just after the crash.

In court Friday, Dove also questioned the care Helton was receiving for injuries she sustained in the wreck.

Dove also argued for a bail reduction and argued that Helton was not a flight risk -- even though she was arrested in South Carolina days after the crash. The judge denied that request.
