A convicted killer returns to court Friday arguing he should be given a new trial.
A jury said Taquan Neblett gunned down clerk Derek Eleam during a robbery at Sami's Music store back in 2004.
Nebelett's attorney's say he should be granted a new trial because of alleged problems with a juror.
Neblett's attorney doesn't feel Neblett received a fair trail. His attorney says Neblett was found guilty by 11 juror's, not 12.
