Judge Denies Motion To Dismiss Hazing Lawsuit

LEXINGTON, Ky. (AP) - A judge in Lexington has denied a motion to dismiss an Eastern Kentucky University student's lawsuit against Kappa Alpha Psi fraternity.

Brent Whiteside filed the suit in January against the Philadelphia-based social fraternity, claiming the group disregarded his heath, safety and welfare when he was a pledge to the EKU chapter.

The Lexington Herald-Leader reported that in April, an attorney for Kappa Alpha Psi filed for dismissal, saying the national organization had no duty to supervise the local chapters' members.

In his lawsuit, Whiteside claims he was repeatedly beaten by members of the chapter as part of initiation rituals in early 2008. He was later hospitalized with kidney failure.

He seeks unspecified punitive damages.
