Charges are dismissed against a man accused of killing a dog.

Robert Suttles appeared in a Pulaski County courtroom this morning.

Suttles was charged with animal cruelty, after being accused of force feeding his dog antifreeze, and then kicking it to death.

Robert Suttles was in court today asking that the charges against him be dismissed.

And despite the objection of prosecutors and outcry from the local humane society, he got his wish.

In July a witness filed a complaint that she had seen Robert Suttles torture and kill a dog on his property.

Suttles was charged with a felony count of torturing a cat or dog.

The charge was a felony because of Romeo's law, which came from another Pulaski County abuse case.

When Suttles walked into district court today his attorney argued that because it had been over 60 days since he had been charged and no indictment hade been filed, the court had no choice but to drop the charges.

The judge agreed.

Now, Commonwealth Attorney Eddie Montgomery will have the option to present the case to a grand jury for a possible indictment.

But for now Montgomery says that isn't likely unless new evidence is presented to him.

The Pulaski County Sheriff's department says it does have an ongoing investigation regarding the case.

Suttles will be back in court on November 19th on unrelated charges.

The humane society says they will continue to push for charges against Suttles.
