A teen is in the hospital and Charles Murphy is one of two people facing charges.

The other is a 14-year-old police have not identified because of their age.

It all started with an argument over balloons and that argument turned violent.

You've probably seen the "It's A Boy” or "It's A Girl" balloons meant to help welcome home a newborn.

Police say someone stole some of those balloons hanging outside a Laurel County home and that's when tempers flared.

Brittany Yaden says friends and family put out several balloons to help welcome home her cousin's newborn baby girl, but at some point, she says some neighborhood boys took them.

She says they brought one back, but the new baby's father, Brad Freeman and friend Shawn Asher went to the house to get the other balloons.

Police say homeowner Charles Murphy hit Shawn Asher in the head with a pipe and a 14 year old boy started beating Asher with a metal baseball bat, leaving Asher with serious injuries.

Police arrested and charged both Murphy and the 14 year old juvenile with assault.

Shawn Asher was listed in critical condition at one point at the UK Medical Center in Lexington.

WYMT-TV was told that his condition has been upgraded to serious and that he's doing better.

The two charged with assault, police say the 14 year old was arraigned Tuesday.

Charles Murphy is expected to be arraigned Wednesday morning in Laurel Circuit Court.
