Death Row Inmate Wins Legal Victory

LOUISVILLE, Ky. (AP) - A federal appeals court has ruled that a
Kentucky Death Row inmate can challenge how the state enforces its
ban on executing the mentally retarded.

The U.S. Sixth Circuit Court of Appeals ruled 2-1, Friday, that
Thomas Clyde Bowling's claim that Kentucky's procedures violate due
process can go forward. The court also said Bowling could raise the
issue of whether a mental retardation claim can ever be filed too
late for consideration.

Bowling faces execution for the 1990 slayings of Lexington
residents Eddie and Tina Earley. He initially asked U.S. District
Judge Karen Coffman to determine whether he was mentally retarded
in December 2005.

    what a joke..these attorneys and judges are out of control..the victims have zero rights but if you casn come up with any excuse you could kill rape torture molest and walk away with sympathy..send this guy to hell where he belongs!!!!

    You've got to be kidding me?!? Now he wants to claim he's retarded and can't be executed??? This man took 2 people's lives, and now he thinks he deserves to live. OK, we'll let you live, but you must agree to be in a straight jacket in a hole with no sunlight exposure ever again, to eat nothing but bread and water. Can you agree to this? I bet not...then I don't agree with any of your claims that you're retarded, especially since you're claiming to have suddenly become retarded in the past 18 never said before Dec of 05 that you were retarded. What BS, our justice system needs to stop letting trash like this waste my tax dollars. PLEASE EXECUTE HIM AT THE EARLIEST AVAILABLE DATE. I'LL DO IT MYSELF IF YOU WILL LET ME.
